Regulation & restricted items
Regulation and restricted items: what to check before a listing or an RFQ
Register updated: 2026-10-25 · SeedMatch Group
Short answer
Whether an agricultural product can be listed, offered, imported or exported depends on the law of each origin, destination and transit country, and on the permits and approvals that apply. This register lists the requirements we have checked against an official or treaty source, with the competent authority and the date we checked it.
Where no current official source is recorded or the rule is unclear, the record says “Regulatory review required before publication or transaction” and the item goes to individual review by our team. The register is not exhaustive and does not replace the authority or a qualified adviser.
General information only, not legal advice, not an approval and not a complete list. Rules change; confirm every requirement with the competent authority or a qualified adviser before acting. SeedMatch Group is not a manufacturer, importer, exporter, seller or regulatory approver.

A plant import permit from the National Plant Protection Organisation of South Africa (NPPOZA, Department of Agriculture) is required to import plants and other regulated articles; the permit is valid for one year. Varieties and propagating material are governed by the Plant Improvement Act 53 of 1976.
Documents and approvals
- Apply for the plant import permit before shipment and follow its conditions.
- Check variety and propagating-material obligations under the Plant Improvement Act.
- For commercial quantities of propagation material, review the department's published criteria and guidelines.
- Phytosanitary certificate from the exporting country and seed lot test data matching the contract.

Commercial seed (sowing seed)
Origin → destination: Any → Kenya · Transit countries: Not assessed — check each transit country
The Kenya Plant Health Inspectorate Service (KEPHIS) implements both the Plant Protection Act (Cap 324) and the Seeds and Plant Varieties Act (Cap 326), so plant-health import controls and seed rules sit with one regulator.
Documents and approvals
- Confirm KEPHIS import conditions (phytosanitary and seed requirements) for the crop and origin before shipping.
- Confirm whether the variety must be registered or officially listed in Kenya for commercial sale.
- Phytosanitary certificate from the exporting country's plant-protection organisation.
- Seed lot label and test data (germination, purity) matching the contract.

Origin → destination: Any → Canada · Transit countries: Not assessed — check each transit country
The Canadian Food Inspection Agency (CFIA) administers the Seeds Act and Seeds Regulations, is the registrar for variety registration, and publishes the seed import requirements ("ABCs of seed importation into Canada").
Documents and approvals
- Check CFIA plant-health import requirements for the crop and origin.
- Prepare an acceptable seed analysis certificate and lot designation as described by CFIA.
- Confirm whether the crop kind requires variety registration in Canada.
- Phytosanitary certificate from the exporting country where required.

Greenhouse tomatoes
Origin → destination: Morocco → European Union · Transit countries: Not assessed — check each transit country
Tomato fruit entering the EU from Morocco needs a phytosanitary certificate issued by ONSSA and must meet the EU's pest-specific conditions for tomato fruit, the EU maximum residue levels and the EU marketing standard for tomatoes. Since 1 January 2025 the EU's ToBRFV rules apply to tomato plants for planting, including seed, not to harvested fruit. A production project should therefore budget for pest surveillance and traceability at the production site, residue monitoring, and a packhouse able to grade to the EU classes.
Documents and approvals
- Phytosanitary certificate — European Commission (DG SANTE)
- Pest-specific conditions for tomato fruit — European Union (Implementing Regulation (EU) 2019/2072)
- Morocco's declared option for point 68 — European Commission (DG SANTE), summary of third-country declarations
- ToBRFV (tomato brown rugose fruit virus) — European Union
- Pesticide residues — European Commission
- Marketing standard — European Union
- Food safety and traceability — European Commission
- Moroccan plant-health control — ONSSA (Office National de Sécurité Sanitaire des Produits Alimentaires)
- Exporter and packhouse registration — EACCE / Morocco Foodex

- Which option ONSSA states for Keiferia lycopersicella (Annex VII point 69) on current tomato certificates; ask the exporter for a recent certificate's additional declaration. Point 68 is recorded as country freedom.
- Any Moroccan tomato-specific export licence, maturity rule, seasonal restriction or quota currently in force.
- EU tariff-quota and entry-price arrangements for Moroccan tomatoes are not covered here.

Fresh blueberries
Origin → destination: Peru → United States · Transit countries: Not assessed — check each transit country
Peruvian blueberries need a phytosanitary certificate from SENASA and must meet USDA APHIS entry conditions, which are published in the APHIS ACIR database. APHIS has authorised cold treatment or methyl-bromide fumigation against fruit flies, and irradiation as an alternative, but confirm the current conditions in ACIR. Covered farms must also meet the FDA Produce Safety Rule, and residues must stay within EPA tolerances. A production project should plan pre-cooling and cold-chain capacity, agricultural-water assessments and packhouse hygiene from the start.

- Fruit-fly treatment options — USDA APHIS
- Produce Safety Rule — US FDA
- Pre-harvest agricultural water — US FDA

Fresh avocados
Origin → destination: Kenya → European Union · Transit countries: Not assessed — check each transit country
Kenyan avocados entering the EU need a phytosanitary certificate from KEPHIS and must meet EU maximum residue levels and the EU general marketing standard. Kenyan exporters also need a Horticultural Crops Directorate export licence and KEPHIS registration, and exports follow AFA season openings and closures. An orchard project should plan traceability, maturity testing, packhouse capacity and cold chain to meet those controls.
Documents and approvals
- Phytosanitary certificate — European Union (Implementing Regulation (EU) 2019/2072)
- False codling moth — European Union
- Pesticide residues — European Commission
- Marketing standard — European Union
- Food safety and traceability — European Commission
- Exporter registration — KEPHIS (Kenya Plant Health Inspectorate Service)
- Export season controls — AFA Horticultural Crops Directorate; reported by KEPROBA
- Season closure notice — AFA (Agriculture and Food Authority)
Still to confirm against a current official text
- The current numerical dry-matter (maturity) threshold. No AFA or KEBS instrument stating it could be read (rechecked 25 Oct 2026): AFA's 27 March 2026 season-opening notice is posted only as an image on its official social-media page, and 2026 press reports differ (24% for Hass and Fuerte versus 20–24% depending on variety). It is therefore not stated here as law; ask the exporter for the threshold applied at their HCD inspection.

How our team applies the register
- Before a product or supplier is published, or an RFQ moves forward, the specialist identifies the product, its origin, destination, transit route and intended use.
- They check sanctions and trade bans, licences, standards, import/export approvals, labelling, safety, customs and transport restrictions that may apply.
- If an official source confirms the item is prohibited, it is blocked from publication, matching and progress. Restricted or uncertain items are held until verified.
- Each decision is recorded with the sources used, the decision, who checked and when.
- Pesticides and other chemicals are treated as sensitive: we do not publish, offer or present a permitted use without explicit official approval in the destination country.
Who is responsible for what
- Buyers and suppliers are responsible for providing accurate details and documents and for obtaining the permits and approvals that apply to them.
- Our team carries out reasonable checks; it does not replace professional advice or an authority's approval.
- Buyers stay free to use the service. Qualifying B2B projects start from USD 250,000.
